This agreement between (Buyers) and Sue and Verle Castle of Purrsncurls Cattery (Sellers) is effective as of the date of the last signature to appear below and is binding upon all parties thereto. Buyer(s) agree to purchase and Seller agrees to sell the below described cat/kitten pursuant to all of the following terms.

For show kittens/cats: Registration papers, MARKED NOT FOR BREEDING, will be provided at the time of

final sale of this cat or kitten.

For breeding kittens/cats: Registration papers will be provided at the time of the final sale of this kitten/cat.

HEALTH GUARANTEE: Purrsncurls Cattery (Seller) guarantees the health of said kitten/cat upon pick-up from the cattery or upon the time of shipment for a period of seventy-two (72) hours. This time period begins at the point that the cat/kitten arrives in the possession of the Buyer. The cat, if shipped, comes to you with a veterinarian’s health certificate and a health record. We recommend that you take the kitten/cat to your own veterinarian (at Buyer’s expense) within the first 72 hours for your own satisfaction and protection. If you have other pets, you must place the new arrival in quarantine during this time and follow the advice of your own veterinarian in regard to the length of the quarantine period. You, or your veterinarian, shall report to Purrsncurls Cattery any medical problem within the guarantee period. If the kitten/cat is found to have a medical problem (within the 72-hour period ONLY), it must be reported to Purrsncurls Cattery within twenty-four (24) hours of its discovery. FAILURE TO MAKE THIS REPORT WITHIN THIS TIME FRAME WILL VOID THIS WARRANTY.

REFUNDS/REPLACEMENTS/EXPENSES: There shall be no refunds of purchase price, deposits, shipping charges or other costs. There shall be replacement of the kitten/cat only under the circumstances provided below:

1) If the kitten/cat is found to be in unsound health by a licensed veterinarian within 72 hours, the kitten/cat shall

be returned to Purrsncurls (at buyers expense) and the buyer may request a replacement with another kitten/cat of equal value.

“Unsound health” shall be defined as any condition that is “life threatening” or “incurable” and shall not include

curable conditions or infections such as colds, virus, bacterial infections or skin rashes. Said replacement

will be made as soon as a suitable replacement becomes available. A medical report signed by the

examining veterinarian must be provided to Purrsncurls prior to the replacement being made.

THERE SHALL BE NO REFUND OR REPLACEMENT UNLESS UNDER THE HEALTH GUARANTEE (WITHIN THE 72 HOUR PERIOD ONLY), EXCEPT AS STATED BELOW.

Purrsncurls will not replace any cat or kitten that has not received adequate and appropriate care from its new owner. It is the responsibility of the Buyer to provide immediate veterinary care (at the Buyer’s own expense) to any kitten/cat showing signs of illness or distress and failure to do so will render any guarantee null and void.

2) Under no circumstance is a kitten or cat to be destroyed prior to notification by the Buyer to Purrsncurls

Cattery. Any kitten cat for which the Buyer expects replacement must be returned to the Seller (at the Buyers

expense) so that identity of the kitten/cat can be verified.

3) Should the kitten/cat die within six (6) months as a direct result of an unknown (at the time of sale) congenital

birth defect, said kitten/cat will be replaced only if an appropriate necropsy is performed by a licensed

veterinarian and a veterinarian’s certificate is provided as proof of cause of death along with all associated

documentation containing lab results from blood and tissue samples, x-rays, shot records, and the

kitten/cat’s registration papers. Trauma, abuse, or neglect will void the guarantee.

4) The kitten/cat’s parents have been DNA tested PKD negative through Catgenes.org. Paperwork will

accompany signed contract and health records the day or shipment or pick-up.

THE BUYER assumes responsibility of all expenses incurred in relation to the kitten/cat after said kitten/cat leaves the possession of Purrsncurls, as well as any expense incurred at the request of the Buyer before the kitten/cat leaves the possession Purrsncurls. If, for any reason, the kitten/cat is returned to Purrsncurls, BUYER

agrees to pay all expenses, including shipping costs, mileage, and re-examination expense of Purrsncurls veterinarian. This examination will include a complete “viral panel” blood test for FELV and FIV viruses.

HEALTH RECORDS: Purrsncurls follows the American Association of Feline Practitioners (AAFP) recommendations for vaccinations by giving the first vaccinations for feline panleukopenia (FP), feline calicivirus (FCV), and feline viral rhinotracheitis (FVR) at 8 weeks and 12 weeks of age, for kittens. If an older cat is being purchased the vaccination booster is given a year following the 12 week vaccination with additional booster vaccinations at 3 year intervals. Rabies is only given for kittens/cats over 6 months of age and cats or kittens being shipped. AAFP recommends that vaccines for feline leukemia (FeLV) and feline infectious peritonitis (FIP) be given only if circumstances warrant. Discuss this with your Veterinarian for determination of whether these vaccinations are necessary for your kitten or cat.

We do not give FELV vaccines as the cats in our cattery have been tested FELV/FIV negative. Purrsncurls prides ourselves in raising healthy, vaccinated, parasite-free kittens. Said kitten/cat leaves Purrsncurls Cattery, to the best of our knowledge, in healthy, well groomed condition.

BREEDING AND/OR SHOW ANIMALS: If a kitten/cat is sold with breeding rights, the Buyer agrees to mate the cat/kitten to another Selkirk Rex or CFA allowable outcrosses defined for Selkirk Rex.

Show kittens/cats are sold with the understanding they are free of disqualifying faults. At the time of sale, they appear to have the correct ear set, head shape, body, eyes, and coat structure required by the CFA Standard for Selkirk Rex. Purrsncurls cannot guarantee the show success of any kitten or cat as show successes are dependent on many outside factors, including, but not limited to: competition, grooming, condition, health, and maturity. Especially in the case of young kittens, we can make an educated guess that they will mature as expected, but have no way to guarantee how the kitten will “shape up” as it grows. We will be happy to share our show experiences with you to help you prepare your kitten or cat for the show ring.

SHIPPING: We really prefer not to ship, if at all possible. We prefer to meet our kitten/cat’s new owners in person and have the kitten/cat picked up. We are also willing to deliver the kitten/cat to a mid point if necessary with mileage/fuel costs being paid for our “delivery” by the BUYER.

If it is necessary to ship, costs for shipping are to be paid by the buyer, when purchasing a kitten/cat that must be shipped. An estimate will be provided to the Buyer. An airline-approved carrier of suitable size will be provided by Purrsncurls, at the Buyer’s expense, at the cost of $40.00. A Health Certificate if required (not to exceed 10 days prior to shipping) at the cost of ($100.00), which includes a rabies vaccination. A “viral blood panel’ test for Felv/FIV can be included at an additional cost for an additional fee (for kittens/cats over 3 months of age). Payment of full purchase price, including shipping costs, must be made in full prior to shipping.

NON-REFUNDABLE DEPOST: A non-refundable deposit is placed to hold a particular kitten/cat for a buyer. All deposits are non-refundable. The goal of Purrsncurls is to place our kittens/cats in loving homes in a timely manner so they may bond with their new family. If a kitten/cat is held specifically for a buyer, a change of mind can quite often jeopardize the chance for that particular kitten/cat to be placed in a home while still at a desirable age. The minimum required deposit amount is one-third of the total purchase price. The remainder of the purchase price is not due until an arranged delivery date. When the sale of the kitten/cat is completed, the deposit shall be applied towards the balance owing on the purchase price.

The Buyer becomes the owner of said kitten/cat upon Purrsncurls receipt of “Payment in Full”. “Payment in Full” and receipt thereof supersedes a signed Sales Agreement being in the possession of the Seller. “Payment in Full” will be held as a binding agreement to purchase said kitten/cat and will be held in lieu of a Sales Agreement being signed by Buyer and returned to Purrsncurls. If the buyer should change his/her mind after “Payment in Full” is made, it will be Purrsncurls discretion whether to refund more than the deposit (1/3 of purchase price) as mentioned above. The kitten/cat will be cared for by the Purrsncurls until the arranged shipping date or until Buyer is able to take possession of the kitten/cat. This period of care is not to exceed fourteen (14) days from date of sale (unless previous arrangements are made between Purrsncurls and the Buyer). Buyer will then have the option to transfer an deposit to a future kitten agreed upon by Purrsncurls. In case of inclement weather, preventing safe air transportation, Purrsncurls agrees to hold kitten/cat at no charge to Buyer until weather is suitable to safely ship.

ADVERTISING RIGHTS: Purrsncurls reserves the right to use photos already in Purrsncurls possession of any and all kittens or cats that are sold to any buyer in any and all advertising, including Internet web-site advertising in the promotion of Purrsncurls Cattery. Buyer agrees to allow Purrsncurls the right to use his/her kitten/cat’s photograph or name in future or existing advertising.

HOUSING, CARE, AND TRANSFER TO THIRD PARTY:

Buyer agrees that this kitten/cat will be kept INDOORS and not allowed to roam freely outside and will provide a loving home and companionship for this kitten/cat.
Buyer agrees to provide quality food and water for the kitten/cat at all times.
Buyer agrees to provide prompt medical attention to this kitten/cat should it become ill.
Buyer agrees that under no circumstances will this kitten/cat be sent to a shelter or given to any pet shop, research laboratory or similar facility.
Buyer agrees that Purrsncurls has the right to retrieve said kitten/cat if Buyer does not adhere to all provisions of this contract or if kitten/cat is being neglected or abused.

VENUE: If any legal action is commenced by Buyer or Purrsncurls as a result of this contract, Buyer agrees that the place of venue for such action shall be McLean County, Bloomington, IL. Buyer assents to personal jurisdiction within such venue regardless of their place of residence and agrees that any judgement obtained is enforceable within the jurisdiction that they reside in as if obtained within that jurisdiction.

FACSIMILE/SCANNED SIGNATURES: A facsimile/scanned signature shall be enforceable as an original if the original contract is lost, destroyed, or other wise unavailable.

TERMS: The use of the terms “kitten/cat” presents the same as the plural “kittens/cats” in the event of more than one kitten/cat being purchased under this sales agreement.
